My son was put in a chok hold by one of his teachers and bruised really bad, what do i do?

My son suffers from Post Traumatic Stress Disorder so he is smaller classes who are trained to give extra assistance to kids like him. But last week during class my son stepped out of the class room like he has been told he can do and has done several times before and when the teacher didn't like it he tried to push my son back into the class room. My son pushed the teacher back and that is when the school said the teacher took my son down with a choke hold. The teacher held him down for so long and with such force that he bruised his entire face, put bruises all around his neck and on his arm, busted his nose and blood balls were in both of my sons eyes. Child protective services and a detective and a police officer all say it was assualt and that the teacher went overboard but now the school is changing their story about what happened to put all the blame on my son and they are trying to press assault and terroristic charges on my son. Has anyone been in my shoes and can you help

Get a lawyer!! If you did that to him it would be child abuse and its still child abuse when the teacher does it.
Reply:How do you know he wasn't provoking the teacher?





If he had it coming then he had it coming, end of story.
Reply:Get an attorney. If your son had done those things to the teacher, he'd be sitting in jail. Your son's PTSD should be documented and on file with the school and your family physician, so you've probably got the upper hand here. See what an attorney says.
Reply:if you have not done so already, take pictures of his injuries and contact a personal injury atty.

Second, I would also contact the local media (TV, radio and newspapers) and tell them your story. As a general rule, schools really don't like negative media attention.

Reply:If the police truly said that the teacher assaulted your son, and you have a copy of the police report, then file charges against the teacher. And retain a lawyer to sue the school.
Reply:The police are involved, as you noted, so the investigation continues. As for the school "changing its story", while this could be malicious on their part--and this is important--it could be that there is a better picture, clearer details, that has since emerged.





It is not normal that teachers attack and batter children. It is normal, sorry to say, for children to describe situations differently and even overtly lie to protect themselves. That is why minors, children or mentally/emotionally handicapped adults cannot be held fully responsible for their actions at all times. Teachers can lie too, but as trained adults their judgment is usually far more correct in a vast majority of situations and events.





You already know that your child has emotional difficulties, beyond simply childhood. Please prepare yourself to face a possible reality--your child may be the one who "went overboard".





Having taught other people's precious darlings for a time, children can be incredibly vicous and have memory and responsibility lapses afterwards that would make polished politicians proud. Your teacher may have been wrong, but your child may not have been the pristine saint you would like to believe. Sorry.
Reply:If what you are saying is true, I'd say I believe the Detectives and say the Teacher went overboard. Get a copy of the Detectives report. Ask the Detective if assault charges are being filed. Contact a good Lawyer right away. I hope you took pictures of your sons face. If not, the Police probably did, get them too if possible. Good Luck.

Reply:With the police report on your side, documented proof of PTSD, get that hospital report, and PICTURES if he's still messed up. Call a lawyer and you'll hear him drooling on the other end of the line...
Reply:Here is the part I hone in on: he is in smaller classes who are trained to give extra assistance to kids like him. If they are trained, and take the responsibility for these kids, they are responsible for any outcome regardless of how badly your son behaved. They should be trained first to difuse the situation before it gets out of hand, that failing they are trained to restrain the child causing the least amount of trauma to the child. Get a lawyer and sue the school, and the teacher.
